PO4U TERMS AND CONDITIONS

This Agreement is a contract between you and Sorcerer's Apprentice and applies to your use of the Services. By using the Service, you must read, agree with and accept all of the terms and conditions contained in this Agreement . We may amend this Agreement at any ime by posting a revised version on the Sorcerer's Apprentice Website. The revised version will be effective at the time we post it.

This Agreement highlights certain risks on using the Services together with guidance on how to safely carry out payments via The Sorcerer's Apprentice. You must consider such risks and guidance when using our service.

The Sorcerer's Apprentice is providing and charging you for an Order Service only.

The Sorcerer's Apprentice PO4U sevice enables you to make payments to third parties.
The Sorcerer's Apprentice is an independent contractor for all purposes.
The Sorcerer's Apprentice does not have control of nor, assumes the liability or
legality for the products or services that are paid for with our Service.
We do not guarantee that a seller will complete a transaction.

Assignment. You may not transfer or assign any rights or obligations you have under this Agreement without Sorcerer's Apprentice’s prior written consent. The Sorcerer's Apprentice reserves the right to transfer or assign this Agreement or any right or obligation under this Agreement at any time without your consent.

You agree that Sorcerer's Apprentice may provide notice to you by posting it on the Sorcerer's Apprentice Website(s), emailing it to the email address you gave us or mailing it to the street address listed in your order.

Notices to Sorcerer's Apprentice. Notices to Sorcerer's Apprentice made in connection with this Agreement must be sent by postal mail to: Sorcerer's Apprentice 6-8 Burley Lodge Road, Leeds LS6 1QP Yorkshire U.K.

Eligibility. To be eligible for our Service, you must be at least 18 years old.

Sending Limits. We may, at our reasonable discretion (for example, without limitation, to limit fraud or credit risk), impose limits on the amount of money you can send through our Service. All orders transhipped must be covered by no more than 10% of the estimated cost you have placed on the order form. That is you must not send us more money than is required to complete your order with the firm you want us to order from. We do not and will not hold accounts in credit. If you send more money than is required to cover for an order we will refund that money minus 5.00 reprocessing fee.

You agree to indemnify us from any return costs to the supplier of your goods if they are unsatisafactory to you. Additionally you agree to pay us a 5.00 fee to process any return and refund.

Funding Source Limitations. In order to manage risk, Sorcerer's Apprentice may limit the Funding Sources available for a transaction. Such a limitation does not mean that either party to the transaction is acting in a dishonest or fraudulent manner. It means there may be a higher-than-normal level of risk associated with the transaction. Our service is for smaller day-to-day items. Orders over 250.00 will not be accepted.

We will accept remittances in the form of British Postal Orders, sterling, dollars and euro cash notes only. We do not accept cheques, banker's cheques, personal cheques,counter cheques, money orders or moneygrams.

Refused Transactions. When you send us money, the firm we order from on your behalf is not required to accept it. You agree that you will not hold Sorcerer's Apprentice liable for any damages resulting from a recipient's decision not to accept a payment made through the Service. We will return any denied payment to your within 30 Days after the date you initiated the payment minus our processing fee of 5.00.

Taxes. It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority. Sorcerer's Apprentice is not responsible for determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction.

Countermanding an Order: You may not countermand an order which has already been placed for you by us. Orders which are countermanded before they are placed with the firm you wanted us to order from will be cancelled and our free for returning your remittance to you will be 5.00 GBP.

Quoted fees are inclusive of all applicable taxes; however, other taxes or costs may exist that are not paid through Sorcerer's Apprentice or imposed by us. You are liable for any associated charges if any as a result of the use by you of the Service.

Restricted Activities. In connection with your use of our service you will not:

• 1. Breach this Agreement , the Acceptable Use Policy or any other agreement that you have entered into with Sorcerer's Apprentice .
• 2. Breach any law, statute, contract, or regulation (for example, those governing financial services, consumer protections, unfair competition, anti-discrimination or false advertising);
• 3. Infringe Sorcerer's Apprentice’s or any third party's copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;
• 4. Act in a manner that is obscene, defamatory, libelous, unlawfully threatening or unlawfully harassing;
• 5. Provide false, inaccurate or misleading Information;
• 6. Send or receive what we reasonably believe to be potentially fraudulent or unauthorised funds;
• 7. Refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us;
• 8. Undertake any action which could amount to unjust enrichment during the course of a dispute by receiving or attempting to receive funds from both Sorcerer's Apprentice and the seller for the same transaction;
• 9. Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
• 10. Do, or omit to do, or attempt to do or omit to do, any other act or thing which may interfere with the proper operation of the Service or activities carried out as part of the Services or otherwise than in accordance with the terms of this Agreement.

If you engage in any Restricted Activities, we may take various actions to protect The Sorcerer's Apprentice, or you from Reversals, Claims, fees, fines, refunds, penalties and any other liability. The actions we may take include but are not limited to the following: We may refuse to provide our Services to you in the future; We may take legal action against you.

You must not use our service in any of the following ways:

Using the Service to order sexually oriented or obscene materials or services in violation of the Acceptable Use Policy; or

Using the Service to order payments for any narcotics, tobacco, other controlled substances, steroids or prescription drugs in violation of the Acceptable Use Policy.

Legal Fees for Acceptable Use Policy Litigation. If either you or Sorcerer's Apprentice commence litigation or arbitration in connection with a fine or other action taken related to our Acceptable Use Policy, the prevailing party will be entitled to recover reasonable attorneys’ fees and costs from the other party and such other party shall commit to bear such costs in addition to any other relief to which it may be entitled.

Disputes between Buyers and Sellers - If you buy an item through our service and either do not receive the item or receive an item that you believe is unsatisfactory, we encourage you to open a Dispute with the seller firm based on the information about the purchase provided by us in our acknowledgement. We will not enter into anything other than a basic supply of information to enable you to pursue your case.

Release of Sorcerer's Apprentice. If you have a dispute with one or more firms, you release Sorcerer's Apprentice (and our officers, directors, agents, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes.

Governing Law and Jurisdiction. This Agreement and the relationship between us shall be governed by English law. For complaints that cannot be resolved otherwise, you submit to the non-exclusive jurisdiction of the English courts arising out of or relating to this Agreement or the provision of our Services without prejudice to your right to also initiate a proceeding against Sorcerer's Apprentice in that context before the competent courts.

Limitations of Liability. We shall only be liable to you for loss or damage caused directly and reasonably forseeable by our breach of this Agreement.

In no event shall we, our affiliates, subsidiaries, agents, suppliers and/or subcontractors be liable for any of the following types of loss or damage arising under or in relation to this Agreement (whether in contract, tort (including, without limitation, negligence) or otherwise: Any loss of profits, goodwill, business, contracts, revenue or anticipated savings; or
Any indirect or consequential loss or damage whatsoever.

No Warranty. We provide the Services to you subject to your statutory rights but otherwise provided without any warranty or condition, express or implied, except as specifically stated in this Agreement. The Sorcerer's Apprentice does not have any control over the products or services that are paid for with our Service and Sorcerer's Apprentice cannot ensure that a seller you are dealing with will actually complete the transaction. We shall not be liable for any delay in the failure in our provision of the Services under this Agreement where uch failure is due to factors beyond our reasonable control.

Indemnification. You agree to defend, indemnify and hold Sorcerer's Apprentice, our affiliates, officers, directors and employees harmless from any claim or demand (including legal fees) made or incurred by any third party due to or arising out of you or your agent’s breach of this Agreement, breach of any law and/or use of the Services.
